Garnishments (M.G.L. c. 246, s. 28)
- An amount not exceeding the greater of 85 per cent of the debtor's gross wages or 50 times the Massachusetts hourly minimum wage (currently $15.00) for each week or portion thereof out of the wages then due to the defendant for labor performed or services render is exempt from garnishment. So the amount protected is $750.00 per week.
- Amounts held by a trustee in a pension plan are exempt.
- This statute does not apply in any proceeding to attach wages or a pension to satisfy a divorce, separate maintenance or child support order.
