Maternity Leave (M.G.L.c. 151B, §105D)
- Employers must provide an eight week maternity leave to female employees for the purpose
of giving birth or adopting a child under the age of 18 (or under the age of 23 if the
child is mentally or physically disabled.)
- This maternity leave can be without pay, but the employer must also be concerned about
the impact of sex discrimination laws and the Family and Medical Leave Act if it chooses
to make it an unpaid leave.
